Sometimes the persons will be charged with the crimes and they will be in a position with short of funds.  Though the individual attached with criminal liability still, can get free legal help through pro bono criminal defense attorney. It means if any person arrested and incarcerated, the person can get free legal help even in criminal areas too.  The individual residing may be elsewhere but the person may be kept in jail which will be located in another locality and individual may not have any influence in such area.  Yet, the sixth amendment to the constitution provided that every person who has been charged with the crime is entitled to have an attorney for defense. Hence it is responsibility of the particular state to provide free defense attorneys in criminal matters to the persons who cannot afford themselves.  It is the constitutional right and the individual should wait till pro-bono legal representation is appointed.

It is true that the attorney may not provide pro bono service unless the crime is heavily publicized or the individual should be a celebrity. Though the individual search for Pro Bono attorney, still many not get.  But as constitutional right, the relevant state should provide such attorney to provide pro bono service in order to protect the constitutional right and to ensure fair trial of the case.

As and when, the individual submit the document stating the lower income, the relevant state will assign an attorney to the individual and costs will be paid state either hourly or by fixed fee.  The appointment of attorney takes place when the individual has been presented first time before the judge. Such appointment known as “assigned counsel”.  The experience lawyers stop practicing such assigned counsel programs, whereas the young lawyers start their practice with this ways and they continue till they build up reputation.  It is preferable to contact state or local bar association to get the referral source to find out the attorneys who take criminal pro bono cases.
